Terms of Use

The short version

  • You must be 18 or older.
  • You own your twin and everything it learns from you.
  • Your selfie must be your own face. It stays on your iPhone.
  • Only share repositories you have the right to share.
  • Your twin can be wrong. It is an AI, not a person, and not a crisis service.
  • The app is free to download.
  • Apple's App Store terms also apply to the download.
  • Malaysian law governs these terms.

1. Agreement

These Terms of Use ("Terms") are a contract between you and Tsuin AI Sdn. Bhd. ("tsuin", "we", "us"). They cover the tsuin app for iPhone and the website at tsuin.ai (together, "the Service").

By signing in or using the Service you agree to these Terms and to our Privacy Policy at tsuin.ai/privacy. If you do not agree, do not use the Service.

Other tsuin products (the desktop app and Team plans) are not yet released. These Terms will be updated before they launch.

2. Who can use tsuin

You must be 18 or older. By using the Service you confirm that you are at least 18 years old. The app is rated 18+ on the App Store. We will close any account we find belongs to someone under 18.

You must also be able to form a binding contract under the law where you live, and you must not be barred from using the Service under Malaysian law or the law of your country.

3. Your account

  • You sign in with Apple. Keep your Apple ID secure; you are responsible for what happens under your tsuin account.
  • One account per person.
  • Tell us at hello@tsuin.ai right away if you think your account has been compromised.

4. Your twin and your data

4.1 You own it

You own your messages, transcripts, answers, skills, feedback, the commit data you share, and the trained twin that results from them ("Your Twin Data"). We do not claim any ownership of it.

4.2 What you let us do with it

You give us a limited licence to store, process and transmit Your Twin Data, and to pass it to the vendors named in our Privacy Policy, only to provide the Service to you. This licence ends when you delete the data or your account, apart from the retention periods in the Privacy Policy.

We will never use Your Twin Data to train a model for anyone other than you.

4.3 Your selfie and likeness

The selfie you take or choose stays on your iPhone and is never uploaded. It must be of your own face. You must not:

  • use a photo of another person to create your twin's look
  • use your twin to impersonate anyone, including yourself, in a way intended to deceive
  • use your twin's output for fraud, harassment or any unlawful purpose

4.4 Your voice

When you hold the mic, your recording is sent to our servers to be transcribed and is then deleted. We do not clone your voice in the iPhone app.

5. Repositories you share

Your twin can learn from commits in repositories you approve. When you approve a repository you confirm that:

  • you have the right to share its contents, including any confidential information in it, and
  • if the repository belongs to an employer or client, you have their permission.

You can revoke a repository at any time from Settings > Shared repos. We then stop observing it and delete what we collected from it.

6. Acceptable use

Do not:

  • break the law, or use the Service to help anyone else break it
  • reverse engineer, decompile or try to extract the source of the Service, except where the law allows it
  • attempt to access other users' twins or data
  • overload, probe or interfere with the Service or its infrastructure
  • use the Service to build a competing product by systematically extracting its outputs
  • feed the Service content you have no right to share

You can report any reply from your twin by long-pressing it. We review reports and may act on them, including by changing how your twin responds or suspending accounts that misuse the Service.

We can suspend or terminate accounts that breach this section.

7. What the twin can and cannot do

Your twin is a machine learning model. It produces text and speech that are predictions based on what you taught it. This means:

  • It can be wrong. Outputs may be inaccurate, incomplete or out of date. Review them before you act on them, especially for anything legal, medical, financial, safety-related or that affects other people.
  • It is not professional advice. Nothing the twin produces is legal, medical, financial, mental-health or other professional advice.
  • It is not a person, and it is not a crisis service. If you write about harming yourself, the app shows crisis helplines instead of a reply. If you are in danger, contact local emergency services.
  • It will say when it does not know. When the twin has not learned enough from you on a topic, it is designed to say so rather than guess.

You are responsible for how you use the twin's output.

8. Price

The tsuin app for iPhone is free to download from the App Store.

Any purchase made through Apple is subject to Apple's payment and refund terms. Request App Store refunds through Apple at reportaproblem.apple.com; we cannot issue them ourselves.

9. Intellectual property

9.1 Ours

The tsuin app, the Shibasuke base model, the training system, the website, the brand and the two shiba mascots belong to tsuin or our licensors. We grant you a personal, non-transferable, non-exclusive licence to use the app under these Terms. We do not sell you the software itself.

9.2 Yours

Your Twin Data is yours (section 4). Output your twin produces for you is yours to use as you wish, subject to section 6 and the rights of third parties whose material you may have fed it.

9.3 The trained twin

The trained twin is a combination of our base model and your data. You own the result. You may not redistribute the Shibasuke base model or use it to offer twins to other people.

10. Apple App Store terms

Because you download the app from the App Store, the following also apply:

  • These Terms are between you and tsuin only, not Apple. Apple is not responsible for the app or its content.
  • tsuin, not Apple, is responsible for maintaining and supporting the app, for any warranty, and for handling any claim relating to the app, including product liability, legal compliance and intellectual property claims.
  • Apple's own Licensed Application End User License Agreement also applies to your use of the app. Where it conflicts with these Terms about the download itself, Apple's terms win.
  • You confirm you are not in a country under a US government embargo and are not on any US government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

11. Ending the agreement

You can stop using the Service at any time and delete your account from Settings > Delete account. This permanently deletes your twin, your conversations, recordings, answers, skills and repository data, and revokes your Sign in with Apple token.

We can suspend or terminate your account if you breach these Terms, if the law requires it, or if we stop offering the Service. If we stop offering the Service entirely we will give at least 90 days' notice and let you export your data until the end.

12. Disclaimers

The Service is provided "as is" and "as available". To the extent the law allows, we make no promises that it will be uninterrupted, error-free, secure or fit for any particular purpose, and we give no warranty about the accuracy of your twin's output.

13. Limitation of liability

To the extent the law allows:

  • We are not liable for indirect, consequential or special losses, lost profits, lost data (beyond our obligations in the Privacy Policy), or losses caused by relying on your twin's output.
  • Our total liability to you for all claims in any 12-month period is limited to the amount you paid us in that period, or RM 500 if you paid nothing.

Nothing in these Terms limits liability for death, personal injury, fraud, or anything else that cannot be limited under the law that applies to you. If you are a consumer in the EU or UK, your statutory rights are unaffected.

14. Indemnity

If someone brings a claim against us because you broke section 4.3 (likeness), section 5 (repositories) or section 6 (acceptable use), you will cover our reasonable costs and losses from that claim.

15. Changes to these Terms

We may update these Terms. For material changes we will give at least 14 days' notice in the app or by email. Continuing to use the Service after that date means you accept the new Terms. If you do not, stop using the Service and delete your account.

16. Governing law and disputes

These Terms are governed by the laws of Malaysia. Disputes go to the courts of Kuala Lumpur, Malaysia, unless the law where you live gives you the right to bring a claim locally.

Before going to court, email hello@tsuin.ai and give us 30 days to resolve the problem with you.

17. General

  • If any part of these Terms is unenforceable, the rest still applies.
  • These Terms and the Privacy Policy are the whole agreement between us about the Service.
  • You may not transfer these Terms to anyone else. We may transfer them to a successor business, with notice.
  • If we do not enforce a term once, we can still enforce it later.
